Who is criminally liable if a corporation commits an unfair labor practice?

A corporation itself cannot be imprisoned, so the law targets the responsible individuals behind the acts. Only the specific officers and agents of corporations, associations, or partnerships who are directly involved are held legally accountable. These individuals must have actually participated in, authorized, or ratified the unfair labor practices to face criminal charges. This standard of personal liability is detailed in Article 259 Labor Code of the Philippines. “The provisions of the preceding paragraph notwithstanding, only the officers and agents of corporations, associations or partnerships who have actually participated in, authorized or ratified unfair labor practices shall be held criminally liable.” 01-Jun-26
