What happens to the offending spouse’s share in the net profits of the absolute community upon legal separation?

A final decree of legal separation triggers severe financial penalties for the spouse found at fault. The offending spouse shall have absolutely no right to any share of the net profits earned by the community. Their share is legally forfeited in accordance with the strict provisions governing marital dissolution profits. This financial consequence is strictly mandated by Article 63 Family Code of the Philippines. “Art. 63. The decree of legal separation shall have the following effects: … (2) The absolute community or the conjugal partnership shall be dissolved and liquidated but the offending spouse shall have no right to any share of the net profits earned by the absolute community or the conjugal partnership, which shall be forfeited in accordance with the provisions of Article 43(2);” 31-Jul-26
