Can the innocent spouse revoke donations made to the offending spouse after legal separation?

Yes, the law strongly empowers the innocent spouse to take back financial gifts given during the marriage. After the finality of the decree, the innocent spouse may legally revoke donations made to the offending spouse. This applies forcefully even if the donations were previously considered final or irrevocable at the time. This right of revocation is explicitly granted under Article 64 Family Code of the Philippines. “Art. 64. After the finality of the decree of legal separation, the innocent spouse may revoke the donations made by him or by her in favor of the offending spouse, as well as the designation of the latter as a beneficiary in any insurance policy, even if such designation be stipulated as irrevocable.” 31-Jul-26
