Does a decree of legal separation sever the marriage bonds between the spouses?
A decree of legal separation drastically changes the marital relationship but does not legally end the marriage itself. While the spouses are permanently entitled to live separately, the legal marriage bonds shall not be severed. Both parties remain legally married to each other and absolutely cannot contract a subsequent marriage. This fundamental limitation of legal separation is stated in Article 63 Family Code of the Philippines. “Art. 63.
