When is a case deemed submitted for decision or resolution by a Commission?
A specific procedural milestone determines when the sixty-day decision period legally begins. A case is deemed submitted for decision upon the filing of the last required pleading. This also includes the filing of the last brief or memorandum required by the rules or the Commission itself. This definition of submission is clearly provided in Article IX, A, Section 7 1987 Philippine Constitution. “A case or matter is deemed submitted for decision or resolution upon the filing of the last pleading, brief, or memorandum required by the rules of the Commission or by the Commission itself.” 06-Mar-26About Nicolas and De Vega Law Offices
