What qualifying circumstances for Rape relate to the victim’s pregnancy, disability, or mutilation?
Rape is qualified for the death penalty when, by reason or on the occasion of the rape, the victim has suffered permanent physical mutilation or disability (Article 266-B, Revised Penal Code). The penalty is also elevated if the offender knew of the victim’s pregnancy at the time of the commission of the crime. A further qualifying circumstance is the offender’s knowledge of the mental disability, emotional disorder, and/or physical handicap of the offended party at the time of the crime’s commission.
