What circumstances related to disease transmission or abuse of military/police position qualify Rape for the death penalty?
The death penalty is imposed when the offender knows that they are afflicted with HIV/AIDS or any other sexually transmissible disease, and the virus or disease is actually transmitted to the victim (Article 266-B, Revised Penal Code). Furthermore, if the offender is a member of the Armed Forces of the Philippines, PNP, or any law enforcement or penal institution, and they took advantage of their position to facilitate the commission of the crime, the death penalty is imposed. These circumstances denote a high degree of criminal depravity or abuse of public trust.
