What items can be impounded during a pending infringement action?

  During the pendency of a case, the court may order the delivery of sales invoices and documents evidencing sales under oath. All articles and packaging alleged to be infringing may also be impounded. Furthermore, the implements used for making the infringing articles are subject to this court order. This authority is granted by Section 216.1 Intellectual Property Code of the Philippines.   “(c) Deliver under oath, for impounding during the pendency of the action, upon such terms and conditions as the court may prescribe, sales invoices and other documents evidencing sales, all articles and their packaging alleged to infringe a copyright and implements for making them.”   January 8, 2026
