When can a court double the amount of damages awarded?

  Damages can be doubled if the infringer circumvents effective technological measures protecting the work. Doubling also applies if a person removes or alters electronic rights management information with knowledge that it facilitates infringement. This penalty reflects the severity of bypassing digital protections or manipulating rights data. These conditions are set forth in Section 216.1 Intellectual Property Code of the Philippines.   “Provided, That the amount of damages to be awarded shall be doubled against any person who: (i) Circumvents effective technological measures; or (ii) Having reasonable grounds to know that it will induce, enable, facilitate or conceal the infringement, remove or alter any electronic rights management information…”   January 8, 2026
