What is the penalty if less serious physical injuries occur during a tumultuous affray and the person responsible cannot be identified?
If the physical injuries inflicted during the tumultuous affray are of a less serious nature and the person responsible cannot be identified, a specific penalty applies to those involved (Article 252, Revised Penal Code). All those who appear to have used any violence upon the person of the offended party shall be punished by arresto mayor from five to fifteen days. This lesser penalty reflects the lower gravity of the resulting physical harm compared to serious physical injuries or death.
