When only serious physical injuries are inflicted during a tumultuous affray and the perpetrator is unknown, what is the resulting punishment?
When a tumultuous affray, as described in Article 251, results only in serious physical injuries to the participants, and the person responsible cannot be identified, penalties are imposed upon all those who used violence (Article 252, Revised Penal Code). All individuals who appear to have used violence upon the person of the offended party shall suffer the penalty next lower in degree than that provided for the physical injuries so inflicted. This penalizes the collective act of violence when individual responsibility for the injuries cannot be fixed.
