What is the exception to the right to bail?

The right to bail is not absolute and has a specific exception for very serious crimes. Persons charged with offenses punishable by reclusion perpetua are not entitled to bail if the evidence of their guilt is strong. In such cases, the court may deny the request for temporary liberty pending the trial. According to Article III Section 13 1987 Philippine Constitution, this limitation is necessary for the administration of justice.   “SECTION 13. All persons, except those charged with offenses punishable by reclusion perpetua when evidence of guilt is strong, shall, before conviction, be bailable by sufficient sureties, or be released on recognizance as may be provided by law…”   28-Jan-26
