What is the presumption regarding the innocence of an accused person?

In all criminal prosecutions, the accused is presumed innocent until the contrary is proven in court. This means the burden of proof lies with the prosecution to establish guilt beyond a reasonable doubt. The accused person also enjoys the right to be heard by himself and through his legal counsel. As provided in Article III Section 14 1987 Philippine Constitution, this presumption is a cornerstone of a fair trial.   “SECTION 14. … (2) In all criminal prosecutions, the accused shall be presumed innocent until the contrary is proved, and shall enjoy the right to be heard by himself and counsel…”   28-Jan-26
