Who is entitled to bail before conviction?
All persons are generally entitled to be bailable by sufficient sureties before their conviction occurs. They may also be released on recognizance as provided by the specific provisions of the law. This right exists even if the privilege of the writ of habeas corpus has been suspended. Based on Article III Section 13 1987 Philippine Constitution, excessive bail shall never be required from any person. “SECTION 13. All persons, except those charged with offenses punishable by reclusion perpetua when evidence of guilt is strong, shall, before conviction, be bailable by sufficient sureties, or be released on recognizance as may be provided by law.
