What happens once an order for the cancellation of a mark registration becomes final?
Once a cancellation order issued by the Bureau of Legal Affairs becomes final, the rights associated with that registration are terminated. This termination applies to the registrant as well as any other persons of record who had interests in the mark. Section 154 Intellectual Property Code of the Philippines requires that a notice of this cancellation be published in the IPO Gazette. This publication serves as public notice that the mark is no longer protected under the previous registration. “SEC. 154. Cancellation of Registration. – If the Bureau of Legal Affairs finds that a case for cancellation has been made out, it shall order the cancellation of the registration.
