How does use of a mark by a related company benefit the registrant?

  The law dictates that any use of a mark by a company related to the registrant directly benefits the registrant themselves. Such use does not negatively affect the validity of the mark’s registration provided there is no intent to deceive the public. According to Section 152.4 Intellectual Property Code of the Philippines, this also applies when the registrant controls the nature and quality of the goods. This allows for corporate structures where subsidiaries or affiliates can utilize the parent company’s branding legally,. “152.4. The use of a mark by a company related with the registrant or applicant shall inure to the latter’s benefit, and such use shall not affect the validity of such mark or of its registration: Provided, That such mark is not used in such manner as to deceive the public.”   January 7, 2026
