How does use of a mark by a related company benefit the registrant?
The law dictates that any use of a mark by a company related to the registrant directly benefits the registrant themselves. Such use does not negatively affect the validity of the mark’s registration provided there is no intent to deceive the public. According to Section 152.4 Intellectual Property Code of the Philippines, this also applies when the registrant controls the nature and quality of the goods. This allows for corporate structures where subsidiaries or affiliates can utilize the parent company’s branding legally,. “152.4.
