What actions constitute trademark infringement regarding the sale and advertising of goods?

  Infringement occurs when someone uses a reproduction, counterfeit, or colorable imitation of a registered mark in commerce without consent. This includes applying the mark to containers or using dominant features in a way that is likely to cause confusion or mistake. Section 155.1 Intellectual Property Code of the Philippines specifies that these acts are prohibited when they involve the sale, distribution, or advertising of goods. Such protections are vital for maintaining market clarity and preventing the deception of consumers. “155.1. Use in commerce any reproduction, counterfeit, copy, or colorable imitation of a registered mark or the same container or a dominant feature thereof in connection with the sale, offering for sale, distribution, advertising of any goods or services… likely to cause confusion, or to cause mistake, or to deceive”   January 7, 2026
