What happens if an employee works past normal hours because there is no replacement?
If an employee cannot abandon their post at the end of normal hours due to a lack of replacement, the extended time is compensable. This scenario is specifically addressed in Rule I, Book III of the Omnibus Rules Implementing the Labor Code of the Philippines. The extra time spent is considered hours worked if the work was necessary or benefited the employer.
