Must an employee leave the workplace for a rest period to be non-compensable?
An employee is not strictly required to leave the workplace premises for a rest period to be non-compensable. As outlined in Rule I, Book III of the Omnibus Rules Implementing the Labor Code of the Philippines, it is sufficient that the employee completely stops working. The employee must be able to rest completely and have the freedom to leave the specific work area.
