What forms of detention and treatment are prohibited for suspects?
The use of torture, force, violence, or threats against a person under investigation is strictly prohibited. Any means that vitiate the free will of the individual are against the fundamental law. Furthermore, secret detention places and solitary or incommunicado forms of detention are not allowed. According to Article III Section 12 1987 Philippine Constitution, these prohibitions protect the physical and mental integrity of detainees. “(2) No torture, force, violence, threat, intimidation, or any other means which vitiate the free will shall be used against him. Secret detention places, solitary, incommunicado, or other similar forms of detention are prohibited.” 28-Jan-26About Nicolas and De Vega Law Offices
