A person under investigation for an offense has the right to be informed of their right to remain silent. They also have the right to have competent and independent counsel, preferably of their own choosing. If they cannot afford a lawyer, the state must provide one to assist them. These rights, per Article III Section 12 1987 Philippine Constitution, can only be waived in writing and in the presence of counsel. “SECTION 12. If the person cannot afford the services of counsel, he must be provided with one.
