What constitutes a “work of the Government”?
This refers to a work created by an officer or employee of the Philippine Government or its subdivisions. Section 171.11 Intellectual Property Code of the Philippines specifies that the creation must be part of the individual’s regularly prescribed official duties. This includes work for government-owned or controlled corporations. Generally, no copyright subsists in these works, though exploitation for profit requires agency approval. “171.11.
