What is a “technological measure”?
A technological measure is any device, technology, or component used to restrict unauthorized acts regarding a work. Section 171.12 Intellectual Property Code of the Philippines explains that these function in the normal course of operation to protect the author’s rights. They are intended to prevent activities not permitted by law or authorized by the right holders. Such measures are crucial for digital rights management in the modern era. “171.12. ‘Technological measure’ means any technology, device or component that, in the normal course of its operation, restricts acts in respect of a work, performance or sound recording, which are not authorized by the authors, performers or producers of sound recordings concerned or permitted by law;” January 7, 2026About Nicolas and De Vega Law Offices
