What are the voting requirements when the Supreme Court hears a case in division?

When the Supreme Court sits in a division, it operates with a smaller group of justices to expedite the resolution of cases. Cases or matters heard by a division shall be decided or resolved with the concurrence of a majority of the Members who actually took part in the deliberations. However, in no case shall a decision be reached without the concurrence of at least three of such Members. This procedural requirement is governed by Article VIII Section 4 1987 Philippine Constitution. “(3) Cases or matters heard by a division shall be decided or resolved with the concurrence of a majority of the Members who actually took part in the deliberations on the issues in the case and voted thereon, and in no case, without the concurrence of at least three of such Members.” 06-Mar-26
