What happens if a division of the Supreme Court fails to obtain the required number of votes?

Divisions within the Supreme Court must meet a specific voting threshold to validly decide a case. When the required number of votes is not obtained in a division, the case must be elevated and decided en banc. Furthermore, no doctrine or principle of law laid down by the court in a decision rendered en banc or in division may be modified or reversed except by the court sitting en banc. These procedural safeguards are dictated by Article VIII Section 4 1987 Philippine Constitution. “When the required number is not obtained, the case shall be decided en banc: Provided, that no doctrine or principle of law laid down by the court in a decision rendered en banc or in division may be modified or reversed except by the court sitting en banc.” 06-Mar-26
