On what grounds may any interested person seek cancellation of a patent or its claims?

  Any interested person may petition for cancellation on specific substantive grounds. Section 61.1, Intellectual Property Code of the Philippines, allows cancellation of the patent or any claim if: what is claimed is not new or patentable; the patent does not disclose the invention sufficiently clearly and completely for a skilled person to carry it out; or the patent is contrary to public order or morality. Section 61.2 permits partial cancellation limited to specific claims or parts of claims where only some claims are affected. These grounds reflect core validity requirements of novelty, sufficiency of disclosure, and compliance with public policy.   21-Dec-25
