In what ways may a patentee request changes in an issued patent, and what are the limits?
A patentee may request changes to limit protection or correct mistakes, but cannot add new disclosure. Section 59.1, Intellectual Property Code of the Philippines, allows the owner to request changes to: limit the extent of protection, correct obvious mistakes or clerical errors, and correct other mistakes made in good faith, subject to a two?year limit for broadening protection and respect for third?party rights relying on the published patent. Section 59.2 forbids any change that would cause the patent disclosure to go beyond the original application disclosure. Section 59.3 requires publication of any changes made.
