Can mistakes in a patent incurred by the applicant be corrected, and under what conditions?
Yes, but only formal and clerical mistakes not caused by the Office may be corrected upon request. Section 58, Intellectual Property Code of the Philippines, authorizes the Director, on request of any interested person and payment of the prescribed fee, to correct any mistake in a patent of a formal and clerical nature not incurred through the fault of the Office. Substantive changes are not covered by this provision and must follow other mechanisms such as change of patent under Section 59.
