How long is the prescriptive period for filing a complaint regarding offenses penalized under the Labor Code?

The law sets a general time limit within which criminal offenses defined under the Labor Code must be prosecuted. Any complaint for an offense penalized by the Code or its implementing rules and regulations must be filed within a specific window. This general prescriptive period is set at exactly three years from the time the offense was committed. Once this three-year period lapses, the offense prescribes, and the violator can no longer be legally charged. This timeframe is established by Article 305 Labor Code of the Philippines. “ART. 305. Offenses. – Offenses penalized under this Code and the rules and regulations issued pursuant thereto shall prescribe in three (3) years.” 02-Jun-26
