Must an employee wait for the resolution of a criminal action before filing a related money claim?
The law allows for the separate and independent processing of civil money claims and criminal liabilities arising from labor violations. An employee does not need to wait for the filing or resolution of a criminal case in regular courts. The money claims specified by the Code can and should be filed before the appropriate labor entity immediately. This ensures that the worker’s financial restitution is not delayed by the potentially lengthy criminal justice process. This independent filing rule is defined in Article 307 Labor Code of the Philippines. “ART. 307.
