How is the penalty for Slight illegal detention affected if the offender voluntarily releases the victim early?
If the offender voluntarily releases the person kidnapped or detained within three days from the commencement of the detention, the penalty is significantly mitigated (Article 268, Revised Penal Code). This mitigation applies only if the release occurs before the institution of criminal proceedings against the offender and they have not attained their intended purpose. In this case, the penalty shall be prision mayor in its minimum and medium periods, along with a fine not exceeding One hundred thousand pesos (P100,000).
