What is the offense of Unlawful arrest, and what is its prescribed penalty?
Unlawful arrest is committed by any person who arrests or detains another without having reasonable ground therefor, or in any case other than those authorized by law (Article 269, Revised Penal Code). Crucially, the arrest or detention must be for the purpose of delivering the person to the proper authorities. The penalty imposed for this offense is arresto mayor and a fine not exceeding One hundred thousand pesos (P100,000).
