How is the penalty for Grave threats determined if the threat is made conditionally and the offender attains their purpose?
Grave threats involve threatening another with the infliction upon the person, honor, or property of the latter or their family of any wrong amounting to a crime (Article 282, Revised Penal Code). If the threat is conditional, demanding money or imposing any other condition (even if lawful), and the offender successfully attains their purpose, the penalty imposed is the next lower in degree than that prescribed by law for the crime threatened to be committed. If the threat is made in writing or through a middleman, the penalty shall be imposed in its maximum period.
