How is the filing date of a design application determined by the Intellectual Property Office?

  The Office accords the filing date as the day it receives an application containing the applicant’s identity and a representation of the article. This rule is set out in Section 116 Intellectual Property Code of the Philippines. If these initial requirements are not met, the filing date becomes the day all elements are finally filed or corrected. Failure to comply with all requirements within the prescribed period will result in the application being considered withdrawn.   “SEC. 116. Examination. – 116.1. The Office shall accord as the filing date the date of receipt of the application containing indications allowing the identity of the applicant to be established and a representation of the article… 116.2. If the application does not meet these requirements, the filing date should be that date when all the elements specified in Sec. 114 are filed…”   January 3, 2026
