How is a dispute resolved if the President claims no inability exists but the Cabinet disagrees?
If the President tries to reassume power but the Cabinet still believes the President is unfit, Congress must decide. The Cabinet has five days to submit a written declaration challenging the President’s return. Congress then convenes within forty-eight hours to debate and settle the issue. A two-thirds vote of both Houses is required to keep the Vice-President as Acting President.
