How does the use of a mark for a single product within a registered class affect other goods in that class?

  If a mark is used for at least one of the goods or services within its registered class, it is protected across the entire class. This prevents the cancellation or removal of the mark in relation to all other products grouped under that same classification. Section 152.3 Intellectual Property Code of the Philippines confirms that partial use satisfies the requirement for the whole class. This allows businesses to expand their product lines within a category without losing their established trademark rights. “152.3. The use of a mark in connection with one or more of the goods or services belonging to the class in respect of which the mark is registered shall prevent its cancellation or removal in respect of all other goods or services of the same class.”   January 7, 2026
