How does the State ensure the protection of indigenous cultural communities?
The State recognizes its duty to protect the rights of indigenous cultural communities to their ancestral lands. This protection is vital to ensure the economic, social, and cultural well-being of these distinct communities. This mandate is carried out subject to the provisions of the Constitution and national development policies and programs. Furthermore, Congress may apply customary laws in determining ancestral domain ownership, as authorized by Article XII, Section 5, 1987 Philippine Constitution. “The State, subject to the provisions of this Constitution and national development policies and programs, shall protect the rights of indigenous cultural communities to their ancestral lands to ensure their economic, social, and cultural well-being.” 22-Mar-26About Nicolas and De Vega Law Offices
