How does the law treat employees who are required to remain “on call”?
Employees who are required to remain on call at the employer’s premises are considered to be working. This treatment is defined in Rule I, Book III of the Omnibus Rules Implementing the Labor Code of the Philippines. It also applies if they are so close to the premises that they cannot effectively use the time for personal purposes. Conversely, if an employee only needs to leave a contact number and is free to move around, they are not considered working while on call. 15-May-26About Nicolas and De Vega Law Offices
