How can a President declare their own inability to discharge their duties?
The President may recognize that they are temporarily unable to perform their official responsibilities. They must transmit a written declaration of this inability to the leaders of Congress. During this period, the Vice-President serves as the Acting President. The President can reassume their powers by sending another written declaration stating they are fit to return. Article VII Section 11 1987 Philippine Constitution “SECTION 11. Whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice-President as Acting President.” 03-Feb-26About Nicolas and De Vega Law Offices
