Can moral and exemplary damages be awarded in infringement cases?
The court has the discretion to impose other terms and conditions it deems wise and equitable. This includes the payment of moral and exemplary damages to the aggrieved party. Even if a defendant is acquitted in a criminal case, the court may still order the destruction of infringing copies.
