What options does a copyright owner have regarding statutory damages?
A copyright owner may choose to recover statutory damages instead of actual damages and profits. This election can be made at any time before a final judgment is rendered in the case. The minimum award for statutory damages is Fifty thousand pesos (Php50,000.00). This choice is available under Section 216.1 Intellectual Property Code of the Philippines. “The copyright owner may elect, at any time before final judgment is rendered, to recover instead of actual damages and profits, an award of statutory damages for all infringements involved in an action in a sum equivalent to the filing fee of the infringement action but not less than Fifty thousand pesos (Php50,000.00).” January 8, 2026About Nicolas and De Vega Law Offices
