Can articles be seized as evidence during an infringement action?

  The court possesses the power to order the seizure and impounding of articles to serve as evidence. This procedure must follow the rules on search and seizure issued by the Supreme Court. Such articles are typically those used in or produced by the infringing activity. This power is detailed in Section 216.2 Intellectual Property Code of the Philippines.   “216.2. In an infringement action, the court shall also have the power to order the seizure and impounding of any article which may serve as evidence in the court proceedings, in accordance with the rules on search and seizure…”   January 8, 2026
