When can statutory damages be reduced by the court?
If an infringer was unaware and had no reason to believe their acts were infringing, damages may be reduced. The court has the discretion to lower the award to no more than Ten thousand pesos (Php10,000.00). However, this reduction is not available if the infringer circumvented technological measures. This rule is found in Section 216.1 Intellectual Property Code of the Philippines. “In case the infringer was not aware and had no reason to believe that his acts constitute an infringement of copyright, the court in its discretion may reduce the award of statutory damages to a sum of not more than Ten thousand pesos (Php10,000.00)…” January 8, 2026About Nicolas and De Vega Law Offices
