Does an infringement action prevent a separate suit for damages?

  The provisions regarding infringement actions do not preclude an independent suit for relief by the injured party. A plaintiff can still seek damages, injunctions, or accounts through other legal avenues. This ensures that the injured party has multiple paths to achieve justice and compensation. This clarification is provided in Section 216.2 Intellectual Property Code of the Philippines.   “The foregoing shall not preclude an independent suit for relief by the injured party by way of damages, injunction, accounts or otherwise.”   January 8, 2026
