Are purely aesthetic creations eligible for patents in the Philippines?
Purely aesthetic creations are not eligible for patent protection in the Philippines. Section 22.5, Intellectual Property Code of the Philippines, clearly lists “aesthetic creations” among non-patentable inventions. These creations are more appropriately protected by copyright or industrial design law, rather than by patents. Since patents are meant to protect technical solutions to problems, a design that is only aesthetic, without technical contribution, falls outside the patent system. 20-Dec-25About Nicolas and De Vega Law Offices
