Can an invention be refused a patent for reasons of public order or morality?
Yes. Even if technically novel and inventive, an invention can be refused patent protection if it is contrary to public order or morality. Section 22.6, Intellectual Property Code of the Philippines, explicitly excludes from patent protection “anything which is contrary to public order or morality.” This clause acts as an overriding public policy filter on what the patent system can legitimize.
