Can plant varieties and animal breeds be covered by patents in the Philippines?
Plant varieties and animal breeds are excluded from patent protection under Philippine law. Section 22.4, Intellectual Property Code of the Philippines, provides that plant varieties, animal breeds, and essentially biological processes for producing them cannot be patented. However, this exclusion does not apply to micro-organisms and non-biological or microbiological processes, which may still be patentable.
