Employers who are already paying their employees a thirteenth-month pay or more in a calendar year are exempt. This includes employers paying its equivalent, such as a Christmas bonus, midyear bonus, or cash bonuses, at the time of the issuance of Presidential Decree No. 851. The equivalent must amount to not less than one-twelfth of the basic salary.
