Originally, employers of household helpers and persons in the personal service of another were exempt under Presidential Decree No. 851. However, a subsequent law changed this legal standard. Under Section 25 of Republic Act No. 10361, also known as the “Batas Kasambahay,” a domestic worker is now legally entitled to thirteenth-month pay.
