Are courts generally allowed to issue injunctions in labor disputes?
The legal system strictly limits general judicial interference in the natural course of labor disputes. No temporary or permanent injunction or restraining order involving or growing out of labor disputes shall be issued by any court or other entity. There are very narrow exceptions provided in specific articles, but the general rule is a complete prohibition. This anti-injunction policy is strictly enforced by Article 266 Labor Code of the Philippines to allow unhindered concerted activities. “ART. 266. Injunction Prohibited. – No temporary or permanent injunction or restraining order in any case involving or growing out of labor disputes shall be issued by any court or other entity, except as otherwise provided in Articles 218 and 264 of this Code.” 01-Jun-26About Nicolas and De Vega Law Offices
